Acceptable Use Policy for BrainUs AI API - Guidelines for responsible and ethical use of our services.

Purpose

This Acceptable Use Policy ("AUP") defines prohibited uses of the BrainUs AI API (the "Service"). This policy protects all users, maintains service quality, and ensures responsible AI deployment.

Violations of this policy may result in immediate suspension or termination of your account without notice.

General Principles

When using the Service, you must:

Comply with all applicable laws in your jurisdiction and users' jurisdictions
Respect others' rights, including privacy, intellectual property, and human dignity
Use the Service responsibly and not in ways that harm others or the Service
Be transparent about AI-generated content where appropriate

Prohibited Activities

Illegal Activities

You may NOT use the Service to:

Facilitate or promote illegal activities in any jurisdiction
Violate local, national, or international laws
Generate content related to child exploitation or abuse
Facilitate human trafficking, violence, or terrorism
Engage in fraud, money laundering, or financial crimes

Harmful Content Generation

You may NOT use the Service to generate:

Content that promotes violence, hatred, or discrimination against individuals or groups
Graphic violent or sexual content
Instructions for creating weapons, explosives, or dangerous materials
Self-harm or suicide-related content
Harassment, bullying, or threatening content

Misinformation & Deception

You may NOT:

Generate deliberately false or misleading information
Create deepfakes, impersonations, or fake identities without clear disclosure
Spread political disinformation or propaganda
Generate fraudulent documents or credentials
Impersonate BrainUs AI, its employees, or authorized representatives

Privacy Violations

You may NOT:

Process personal data without proper consent and legal basis
Generate or infer sensitive personal information about individuals without authorization
Dox individuals (reveal private information)
Violate data protection laws (GDPR, CCPA, etc.)
Use the Service to track or surveil individuals without consent

Unauthorized Access & Security

You may NOT:

Attempt to reverse engineer, decompile, or extract the underlying models
Bypass rate limits, security measures, or access controls
Probe, scan, or test the Service's vulnerabilities
Access or attempt to access other users' accounts or data
Use the Service to attack or compromise other systems

Content Restrictions

Spam & Mass Distribution

You may NOT:

Generate spam, unsolicited messages, or bulk communications
Use the Service for phishing or social engineering attacks
Create fake reviews, testimonials, or social media content at scale

Intellectual Property

You may NOT:

Generate content that infringes on copyrights, trademarks, or patents
Reproduce or closely mimic copyrighted works
Use the Service to plagiarize or pass off others' work as your own

Misleading Attribution

You may NOT:

Represent BrainUs AI outputs as human-generated when that fact is material
Remove required attribution (as specified in your plan)
Misrepresent the source or capabilities of the AI

Technical Abuse

Service Abuse

You may NOT:

Abuse free-tier access for production use
Engage in denial-of-service attacks or resource exhaustion
Use the Service in ways that degrade performance for other users
Create multiple accounts to circumvent rate limits or plan restrictions

Reselling & Redistribution

You may NOT:

Resell API access without authorization
Build competing AI services using our API
Redistribute API responses at scale without proper licensing

Model Extraction

You may NOT:

Attempt to replicate or extract our models through systematic querying
Use outputs to train competing models
Systematically probe the model to understand its architecture or training data

Educational Use Guidelines

Given BrainUs AI's focus on education in Sri Lanka, the following restrictions are critical:

Academic Integrity

You may NOT use the Service to:

Complete homework, assignments, or exams on behalf of students (without disclosure)
Generate exam questions that mimic official exams
Facilitate cheating or plagiarism
Create "essay mills" or assignment completion services

Permitted: Using the Service as a study aid, tutor, or learning tool where AI assistance is disclosed and permitted.

Educational Impersonation

You may NOT:

Impersonate teachers, professors, or educational staff
Create fake educational credentials or transcripts
Impersonate the Ministry of Education or examination boards
Generate content falsely labeled as "official" educational materials

Responsible Educational AI

When building educational applications, you MUST:

Clearly indicate that content is AI-generated
Not represent AI outputs as verified, official answers
Encourage critical thinking and verification
Respect academic integrity policies of educational institutions

Student Privacy

If your application serves students, you MUST:

Comply with child privacy laws (COPPA, GDPR provisions for minors, etc.)
Not collect unnecessary personal data from students
Provide clear privacy notices to parents/guardians (for minors)
Implement appropriate data security for student information

Reporting Violations

How to Report

If you observe violations of this policy, report them to:

Information to Include

When reporting, please provide:

Description of the violation
API key or account identifier (if known)
Evidence (e.g., API responses, screenshots, timestamps)
Your contact information

Our Response

We will:

Investigate all credible reports promptly
Take appropriate action, including suspension or termination
Notify you of the outcome (where appropriate)

Enforcement

Violation Consequences

Depending on severity, violations may result in:

Warning: First-time or minor violations
Temporary Suspension: Serious or repeated violations
Permanent Termination: Severe violations, illegal activity, or repeated offenses

We reserve the right to terminate accounts immediately without warning for severe violations.

Automated Detection

We use automated systems to detect violations, including:

Content analysis of prompts and outputs
Anomaly detection for usage patterns
Rate limit and abuse monitoring

Appeals

If you believe your account was suspended in error:

Email appeals@brainus.lk with:
- Your account details
- Explanation of why you believe the suspension was incorrect
- Any supporting evidence
We will review and respond within 5 business days

Updates to Policy

We may update this AUP to address new risks, legal requirements, or service changes. Updates will be communicated via email or dashboard notification.

Continued use of the Service after updates constitutes acceptance of the revised policy.
