Terms of Service

1. Agreement to Terms

By accessing or using the BrainUs AI API (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and developers who access or use the Service.

2. API Access & Usage Rights

2.1 License Grant

BrainUs AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the API in accordance with these Terms and your selected plan.

2.2 API Keys

You are responsible for maintaining the confidentiality of your API keys. All activity under your account is your responsibility. Immediately notify us of any unauthorized use.

2.3 Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without uptime guarantees for free-tier users.

3. Brand & Attribution

3.1 Permitted Use

You may use the following attributions:

"Built using BrainUs AI"
"Powered by BrainUs AI API"
"Uses BrainUs AI services"

3.2 Prohibited Use

You may NOT:

Claim BrainUs AI or its models as your own proprietary technology
Rebrand BrainUs AI outputs as a different AI system or model
Remove or obscure BrainUs attribution where required by your plan
Use BrainUs AI trademarks, logos, or brand assets without prior written permission

3.3 Attribution Requirements by Plan

Free Plan: Attribution required ("Powered by BrainUs AI")
Pro Plan: Attribution optional but appreciated
Enterprise Plan: White-label options available

4. Free vs Production Use

4.1 Free Tier Restrictions

The Free tier is intended for development, testing, and evaluation purposes only. Free-tier access may NOT be used in production environments serving end users.

4.2 Production Use Definition

Production use includes but is not limited to:

Deployed applications with active users
Commercial services or products
Any application generating revenue
Business-critical operations

4.3 Upgrade Requirement

You must upgrade to a paid plan before deploying any application to production. Violation of this policy may result in immediate service suspension without notice.

5. Usage Limits & Enforcement

5.1 Rate Limits

Each plan has defined rate limits and quotas. Exceeding these limits may result in temporary throttling or request rejection.

5.2 Fair Use Policy

Even within plan limits, we reserve the right to throttle or suspend accounts exhibiting:

Abnormal usage patterns
Abuse detection (spam, scraping, etc.)
Resource-intensive operations affecting service quality

5.3 Enforcement Actions

We may, without notice:

Rate limit or throttle your requests
Suspend your API access temporarily or permanently
Terminate your account for serious violations

6. Ownership of Outputs

6.1 Your Ownership

You retain all rights to the outputs generated through the API based on your input prompts, subject to these Terms.

6.2 Our Rights

BrainUs AI retains all rights to:

The API itself and underlying models
Service improvements and analytics
Aggregated, anonymized usage data

6.3 No Liability for Outputs

BrainUs AI is not responsible for the accuracy, completeness, legality, or fitness for any purpose of API outputs. You are solely responsible for verifying and using outputs appropriately.

7. Prohibited Uses

You may not use the Service to:

Generate, distribute, or promote illegal content or activities
Harass, abuse, threaten, or harm others
Impersonate individuals or entities
Violate intellectual property rights
Attempt to reverse engineer or extract the models
Resell or redistribute API access without authorization
Bypass rate limits or security measures
Scrape, harvest, or collect user data without consent

8. Education-Specific Terms

Given BrainUs AI's focus on education in Sri Lanka, the following additional restrictions apply:

8.1 Prohibited Educational Uses

Exam Integrity: Do not use the Service to generate, leak, or distribute actual exam questions or answers
Impersonation: Do not impersonate educational institutions, teachers, or government bodies
Misrepresentation: Do not claim AI-generated content as "official answers" or endorsed educational materials
Academic Dishonesty: Do not facilitate or encourage cheating or plagiarism

8.2 Educational Use Guidelines

When building educational applications, clearly indicate that content is AI-generated and should be used as a learning aid, not as definitive or authoritative educational material.

9. Account Suspension & Termination

9.1 Suspension by Us

We may suspend or terminate your access immediately and without notice if you:

Violate these Terms
Engage in fraudulent or illegal activity
Pose a security risk to the Service
Fail to pay for services (paid plans)
